We consider ourselves to be highly honourable people and we believe that if we provide an excellent service for you, then we also honour ourselves, the organisations we represent, and Orkney. This is why we will do everything in our power to ensure that our website is accurate and that any work you subsequently ask us to perform for you proceeds safely and to your exact instructions and in accordance with Scottish Law. However, we have found it necessary to protect ourselves by formally stating the terms by which we offer our website and services, so please read our 'small print' ...

Although to date we have only rarely had to cancel a tour, ritual, or any other service we offer, in commissioning our services, you accept that sometimes the unexpected does happen and it is impossible to mitigate for all possibilities. We always expect to honour any agreement with you, and in particular to attend on the date and time agreed, at the place agreed, and in the manner agreed, and to contact you in the event of there being any problem regarding any aspect of your booking. You understand that we will do everything we can to honour our agreement with you, but that under some circumstances we may have to cancel or postpone any agreement without notice or compensation. Such circumstances would include fire, flood, drought, weather conditions, war (whether declared or not), acts of terrorism, civil disturbance, industrial disputes, act of God, personal injury or illness, any restrictions or recommendations put in place by state or local authorities to stop the spread of contagious diseases or pandemics, being called for jury service or as a witness in a trial, any disruption to the ferry or public transport service, or any other cause beyond our control making it impossible or unreasonable for us to fulfil any contract.
As Orkney is a remote place, we do always try to mitigate for unforeseen circumstances, for example, in the event of one of us being unavoidably unable to act as celebrant or tourist guide, the other of us may be able to step in at short notice instead. Obviously, if we have to cancel for any reason beyond our control, we will refund any monies paid by you to us – although we will not be responsible for any fluctuations in the exchange rate or value of the £GB in the interim, if applicable.
To ensure that everything proceeds according to your plans and to minimise misunderstandings, we recommend that you plan ahead and communicate with us as much as possible, we will do likewise with you.
In all circumstances, you agree that the absolute limit of our liability to you or to any other party is strictly limited to the return of any monies paid by you to us. In addition, you will not hold us liable for any consequential loss or damage whatsoever, however caused. If you are concerned about this, we advise you to take out insurance to cover cancellation in all circumstances.
Insurance advice: We strongly recommend that you ensure that you have comprehensive insurance (travel or other applicable) for yourselves and your group. Some of the sites you may visit whilst in Orkney are old, remote, or not maintained; many of them were built before equality of access for people with disabilities was a consideration. We will not cover any liability arising from you approaching or entering sites and structures (such as walking along roads with no pedestrian access to gain access), whether it is with us, without us, or on our recommendation. At all times, you are wholly and solely responsible for assessing whether entering or approaching a site is safe and appropriate for you; you approach and enter all sites at your own risk and we will not be responsible for any losses, injuries or damage that may arise. We will always do our best to attend the sites as agreed with you, but we are not liable for unforeseen circumstances that limits access, for example severe weather or site closure. If it becomes necessary for us to change plans, or if there are unforeseen circumstances affecting plans, then we will offer alternatives. If adverse weather affects your arrival in Orkney and you cannot keep your planned booking with us, then you will need to discuss this with your insurance provider as we will not be liable for any of your losses. For passengers arriving by cruise liner, whose ship is unable to arrive in Orkney as planned, whether weather-related or due to other unforeseen circumstances, you should discuss this with your insurance provider as we will not be liable for any of your losses.

Although we will always try to respond sensitively, please consider any reservations fees / deposits / balance fees requested by us, or paid to us, as non-refundable. Reservation fees and deposits cover us for reserving dates and advance preparation:
* For ceremonies, we normally request a reservation fee of £100GB with the balance of any fees due to us to be paid within 8 weeks of your reserved date, or at the time of booking if less than 8 weeks notice given. Any balances requested by us or paid to us are also non-refundable if cancelled within 8 weeks (56 days) of your reserved date. We
require full payment to be made in advance of your ritual taking place and funds must be cleared prior to the
'big day' / day of the ceremony.
* For tourist guiding for private groups
we normally request a reservation fee in advance, with the balance to be paid at the end of the tour in £GB. Please refer to our cancellation policies in our fees
section.
* For tourist guiding for commercial agencies and travel agents, and for ALL coach tours
(including minibus and midi-coach), we normally request a reservation fee in advance of £100GB per date, this particularly applies if you require us to plan a detailed itinerary and make bookings on your behalf. We then ask for the balance to be paid in full 28 days before (i.e. in advance of) the start of the tour. In the event that you cancel, or partially cancel, with less than 14 days' notice (prior to the start date of the tour) this balance is non-refundable. Any refunds will be subject to an administrative charge to cover our additional costs. Please refer to our cancellation policies in our fees
section.
* We will, on request, accept alterations and postponements to bookings, for which we reserve the right to make an additional charge. * We will, at our discretion, vary these terms and conditions (usually in your favour), and if we do, we will make the revised terms and conditions clear.

If we recommend public transport options to you, or travel with you on public transport (including but not limited to: ferry, 'plane, bus, taxi), or recommend hire car services to you, we are not responsible for the safety or reliability of the transport. At all times, you are wholly and solely responsible for assessing whether a method of travel is safe and / or reliable and / or meets your requirements; we will not be responsible for any losses, injuries or damage that may arise. When hiring a car in Orkney / Scotland / UK, ensure that you reserve a vehicle with an automatic gear box if you need one (most hire cars in the UK are manual or 'stick' gear boxes) and ensure that you have your original driving licence and ID with you when collecting the car.
The following three (3) paragraphs
apply only to legal wedding ceremonies; non-legal rituals
are NOT subject to the same constraints:
The
legal aspects (i.e. obtaining and returning the marriage schedule) of
your wedding ceremony are wholly and solely your responsibility. We may
offer you general advice in this regard but have no other liabilities to you.
You agree that unless you provide to us a valid Marriage Schedule prior
to the date of the ceremony, we will not be able to proceed with your
ritual if your ritual is intended to be a legal wedding ceremony. You
agree that the acceptance by us of any monies from you, whether as a
deposit to secure a specific date or as final payment, neither implies
nor confirms your legal right to enter into a marriage contract with
each other nor with anyone else. We advise you to seek guidance on this
from the General Register Office for Scotland. Where necessary, you will
also need to seek advice and permission to marry from relevant
Embassies – this applies if you are nationalities of any country other
than the UK – for some countries you may need to obtain marriage visas.
Please note that for legal reasons there are some circumstances when we may not be able to proceed with performing your legal wedding ritual, despite your having booked with us and providing a valid marriage schedule. These include if we suspect that either party to the marriage is being forced to do so against their will, or does not understand that it is a legal marriage that is being performed (this includes if there is a language or disability issue), or if we have any suspicion that the couple are in a 'sham' relationship for the purposes of getting married (usually applies to UK residency issues). If we have any doubt that both parties to the marriage actually intend to get married or either party is not in a 'fit state' to get married (e.g. is inebriated or under the influence of drugs or alcohol) during the ritual, we may also have to decline to proceed with the ritual. At all times, the final decision whether or not to proceed with a legal wedding ceremony rests solely and absolutely with the celebrant and registrar, because to go ahead with a ceremony in circumstances such as those given in this paragraph may constitute a criminal offence and may result in a custodial sentence for the celebrant. Most of these problems can be resolved by communicating with us and designing a solution, for example by using the services of a translator, but these arrangements need to be made in advance. The marriage schedule also needs to be correct prior to proceeding, but these problems can be sorted by the registrar very quickly. To date, we have NEVER had a problem of this sort BUT we do feel it fair to warn all couples of our legal duties as celebrants.

The hiring and gaining permissions to use any venue(s) for your ceremony, tour, or other event, are wholly and solely your responsibility. We may offer you advice and assistance in this regard but have no other liabilities to you.

You are wholly and solely responsible for your own and your guests’
behaviour at any venue(s) and you agree to fully indemnify us against
any claims made by the landowner or any other party, for damage to the
venue(s) or other parties, howsoever caused. Neither you nor your guests
will throw confetti, rice, flower petals, etc. at the venue(s), nor leave any
rubbish or anything that could be considered litter, unless you have the
express permission of the landowner to do so (please note that Historic
Environment Scotland will NOT provide permission to do this at any of
their sites). You are wholly and solely responsible for informing your
guests of this and for ensuring that they comply with these
instructions.
If
you, or any person in your party, causes a nuisance, conducts
themselves in an offensive or disorderly manner, or threatens, in any
way, theirs or the safety of others, we reserve the right to refuse service.
In these circumstances, we will not be responsible for any injury or
damage caused by you as a result of your behaviour. If we are providing
guiding services to you, as step-on guides (as passenger(s) in your
vehicle), and your driving and / or ability to control the vehicle
causes us concern, for whatever reason, we reserve the right to refuse service. In the event that we have to refuse the right of service, for whatever reason, all monies paid by you to us will be forfeit.

Because we process personal information electronically (i.e. we write ceremonies which may include information which could be used to identify individuals, and we then usually send these ceremonies to you for approval by email attachment in Microsoft Word format), we have registered with the Information Commissioner’s Office (ICO) as ‘Spiritual Orkney’; with ‘Orkney Pagan Weddings’ being one of our trading names. What information is collected by Spiritual Orkney?

We collect and retain personal details (names and contact details) from people enquiring about our services.
If you decide to proceed with procuring our guiding or celebrancy services, we will ask you for additional information. Some of the data we request from you will, by nature, be classified as 'sensitive' (e.g. religious beliefs).
You may, at any point, refuse to answer any of our questions or refuse to supply any information to us. It is also your choice as to the amount of detail you provide to us. If you do choose to limit the information you provide to us, we may have to discuss with you whether or not we can continue to supply the service(s) you request.
Where the information we collect comes from:
The information we hold on you, only comes from you, or from people nominated by you to supply information to us (such as a relative providing a poetry reading as part of your ritual). This is how we acquire information:
- When you first contact us by telephone, by email, or by filling in an on-line form (which we receive in email format).
- When you submit your ‘Initial Information Request’ form to us (applies only to ceremonies).
- When you communicate further with us; this may be by telephone, via email, in person, by post, by SKYPE or ZOOM, or text message, or any other method which you ask for. We might make hand-written notes whilst communicating with you which we may subsequently type up into electronic documents (usually Microsoft Word).
We collect information about you in order to provide to you the service(s) which you request of us, and so that we can contact you if any issues arise.
Although we ask you to supply personal information or contact data to us, we do so solely for the purposes of communicating with you and providing you with the service(s) you request from us, and for our administrative reasons (such as record keeping in order to complete our tax returns to HMRC).
Who will information be shared with:
We don’t share your personal information with anyone, unless we have your permission to do so. We NEVER sell or pass on your personal information or contact data without your permission. The exception would, of course, be if we needed to act in the public interest or were required to do so by law (for example, to assist with a police or other serious investigation) but we would hope this situation would never arise.
If you ask us to provide an additional service (such as a bag-piper or florist) we supply that service provider only with the information they need to provide that service (such as the tunes you wish to have played on the bag-pipes, and the place, time and date of the ceremony, or the types of flowers requested).
If someone contacts us to double-check details of your ceremony, including the Registrar, our policy and practice is to pass their query to you, to answer directly, rather than to answer on your behalf.
Occasionally the Registrar will contact us to clarify some issues (this only applies to legal wedding ceremonies and may happen if the M10 form has not been completed fully) and we always ensure that the Registrar fully identifies themselves to us before answering their questions. We use our professional discretion if the issue being raised is intrinsic to the timely issuing of your marriage schedule (without which your marriage ceremony cannot proceed).
How is your information stored?
We store your information in paper, digital, on-line and electronic format and, if you submit information to us, you agree and consent to us storing your data in these formats and for these purposes. We endeavour to keep any information pertaining to you private and secure in whatever format we hold it.
Transferring your data outside of the European Economic Area
If you reside or are located outside of the European Economic Area (EEA), or if you communicate with us from outside the EEA, it will almost certainly be necessary to transfer your personal data outside of the EEA in order to communicate with you. Where the transfer of data outside of the EEA takes place, we will make sure that it is protected in the same way as if the data was inside the EEA, and it will only occur with your consent. This consent is implied by you, if you ask us to reply to an email or postal address that is located outside of the EEA.

We keep invoices indefinitely for record keeping, accounting, and for HMRC inspection. These may have your contact details on them.
We keep copies of some of the ceremonies we have written. We aim to retain these in an anonymised format electronically, and we aim to anonymise them within one month of your ceremony having taken place.
We securely archive paper records. We also keep documents electronically in archived format (i.e. physical external hard disc drives which are held securely).
If you are ask us to take photographs of your ceremony, we keep them in an electronic archived format (i.e. physical external hard disc drives which are held securely) and we do this in case you need to request an additional copy from us (perhaps the USB drive we send you containing your wedding photographs will not work, or you accidentally erase its contents ... yes, this has happened!).
Your email address may be stored indefinitely in one of our on-line email address books. Your emails may also be stored, although we aim to delete them within one month of your ceremony having taken place.
Following relationship ceremonies, we usually post (mail) a congratulatory card at the first anniversary. For this purpose, we retain your postal address, as last notified to us, for one year after the ceremony.
If you (kindly, thank you) agree to give us permission to use your testimonial, name, details, or image / photograph on our web-sites or on social media, then we will continue to do so indefinitely at our discretion or unless you exercise your right to ask us to stop using it or to correct or amend it. If you ask us to, we will make these changes within 14 days of being asked and of receiving and understanding your request.
If you ask us to arrange for a notice of your ceremony to be published elsewhere, for example a local newspaper, you understand that we have no control over that publisher, publication, or web-site, other than to ensure that the information we provide to them is correct. If you do ask us to arrange for a notice of your ceremony to be published elsewhere, you do so in the full understanding that, once in the public domain, it is virtually impossible to withdraw publication permissions retrospectively.
We are always delighted to keep in contact and continue in communication with anyone who requests us to, for as long as you wish us to, but this request does need to come from you.
Children's Privacy Protection
This website and all our services are directed to adults. They are not directed to children under the age of 16. We operate in compliance with current regulations. Anyone under the age of 16 must provide parental consent to use this site and / or our services.
